It is Time to Finally Reform the Patriot Act
National Security Letters (NSL) are demands for customer records from financial institutions, credit bureaus and communications service providers. They have existed for decades, but prior to passage of the Patriot Act, they were limited to collecting information on suspected terrorists or foreign actors.
Recipients are gagged from telling anyone -- besides their lawyers and anyone else whose help is necessary to respond to the request -- that they either received or complied with a NSL. The gag has been struck down as unconstitutional but remains on the books. In 2007 and 2008, the Justice Department’s Inspector General reported that upwards of 50,000 NSLs are now issued each year, many of which obtain information on people who have no relationship to a suspected terrorist.
Through NSLs, the FBI can compile vast dossiers about innocent people and obtain sensitive information such as the web sites a person visits, a list of e-mail addresses where a person has sent e-mail, or even unmask the identity of a person who has posted anonymous speech on a political website. Since the Patriot Act was authorized in 2001 -- further relaxing restrictions on the FBI's use of the power -- the FBI has astronomically increased its use NSLs.
The overwhelming majority of NSL requests seek our most sensitive information -- telephone bills, email subscriber information, and financial records. The FBI uses NSLs to establish evidence to support secret wiretaps, electronic surveillance and search warrants, but keeps the information it collects with NSLs even if it determines that the person is completely innocent of involvement with terrorism or a crime.
FBI officials have not kept accurate records about the NSLs they issue or how the information is being used. Plus, the information gathered from NSLs stays in the FBI’s databases forever even if it has no relevance to any investigation.
